Terms of Service

These Terms of Service form a binding agreement between you and Tollbeam for your use of the Service. By creating an account, clicking to accept, accessing the dashboard, or using the APIs, you agree to these Terms.

If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms, and references to "you" include that entity.

You must provide accurate account information and keep it current. You are responsible for all activity that occurs under your account, including activity by team members, contractors, or anyone using your credentials.

You must maintain the confidentiality of passwords, API keys, webhook secrets, and any other credentials issued for the Service. You must notify Tollbeam promptly if you believe your account or credentials have been compromised.

Tollbeam provides software and infrastructure for account abstraction workflows, including hosted dashboards, reporting, routing, developer tooling, and integrations related to sponsored or fee-managed blockchain transactions.

We may modify, improve, suspend, or discontinue features from time to time. We may also impose reasonable usage limits, rate limits, or technical controls to protect the integrity, security, or availability of the Service.

You are responsible for your applications, smart contracts, transaction payloads, project configurations, billing choices, and all use of the Service under your account. You are also responsible for ensuring that your use of the Service complies with applicable laws, regulations, and industry standards.

Blockchain networks, bundlers, paymasters, wallets, and other third-party systems are outside Tollbeam's direct control. You acknowledge that confirmations, execution timing, mempool behavior, gas costs, network congestion, forks, and other chain conditions can affect transaction outcomes.

You agree to pay all fees, usage charges, spreads, prepaid amounts, and other charges associated with your account. Fees may depend on transaction volume, network, sponsorship activity, or a separate commercial agreement.

Unless otherwise stated, fees are non-refundable. You are responsible for all taxes, duties, levies, and similar governmental charges associated with your use of the Service, excluding taxes based on Tollbeam's net income.

You must use the Service only for lawful purposes and in accordance with these Terms and the Acceptable Use Policy. The Acceptable Use Policy is incorporated into these Terms by reference.

Tollbeam may investigate misuse, suspected fraud, sanctions concerns, security incidents, or abusive traffic patterns. We may suspend access, throttle traffic, revoke credentials, or require remediation where reasonably necessary to protect the Service, our users, or third parties.

Tollbeam and its licensors retain all rights, title, and interest in the Service, including software, documentation, branding, reports, and any related intellectual property. These Terms do not transfer ownership of the Service to you.

You retain ownership of the content, configuration data, and materials you submit to the Service. You grant Tollbeam a limited right to host, process, transmit, and display that material as needed to provide and secure the Service.

If you provide suggestions, feedback, or feature requests, Tollbeam may use them without restriction or obligation to you.

You may stop using the Service at any time. Tollbeam may suspend or terminate access immediately if you materially breach these Terms, create security or legal risk, fail to pay amounts due, or use the Service in a way that could harm Tollbeam, other customers, or third parties.

Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination, including payment obligations, disclaimers, limitations of liability, and indemnity, will survive.

The Service is provided on an "as is" and "as available" basis except to the extent otherwise expressly stated in a written agreement signed by Tollbeam. To the maximum extent permitted by law, Tollbeam disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Tollbeam does not guarantee uninterrupted availability, error-free operation, profitability, transaction inclusion, transaction success, or that third-party providers or blockchain networks will remain available or compatible.

To the fullest extent permitted by law, Tollbeam will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, digital assets, or business interruption arising out of or related to the Service.

To the fullest extent permitted by law, Tollbeam's total aggregate liability arising out of or relating to the Service will not exceed the amount you paid Tollbeam for the Service during the twelve months before the event giving rise to the claim.

You will defend, indemnify, and hold harmless Tollbeam from claims, losses, damages, liabilities, and expenses arising out of your applications, your use of the Service, your breach of these Terms, or your violation of law or third-party rights.

Tollbeam may update these Terms from time to time. If we make a material change, we will post the updated Terms on this page and update the last updated date. Your continued use of the Service after the effective date of updated Terms means you accept the revised Terms.

These Terms are governed by the laws applicable to the Tollbeam contracting entity and the courts with jurisdiction over Tollbeam's principal place of business, unless a separate written agreement provides otherwise or applicable law requires a different forum.
